The following statement has been published with the full approval of Michael Naughton.
I am Michael Thomas NAUGHTON, Director/Private Investigator of Lewis Legal, Private Investigations.
In June 2011 I was instructed by Mr Sylvester WILSON of North Wales Recovery, to carry out investigations relating to the discovery of the identity of the person or persons responsible for posting what have been alleged malicious “blogs” on the web site http://www.thoughtsofoscar.blogspot.com contrary to the “Improper use of the pubic electronic communications network sec 127 of the Communications Act 2003”.
After carrying out my own Due Diligence procedures I accepted the investigation.
Mr Wilson presented me with 7 documents each one containing between 3 to 4 sheets, each document stapled together. I have marked these exhibits 2 to 8. These documents including my original witness statement was passed to Mr WILSON on the completion of my investigation.
On page one of each document there is a image extracted from the thoughts of Oscar blog spot site. Using software freely available at http://regex.info/exif.cgi it is possible to download images that have originally been taken using a camera built into an Smart Phone and if the user has not disconnected the “location finder” software built into the phone, the “regex.info” software will provide the longitude and latitude of where the user was located when obtaining the image.
One of the suspected named to myself is Mr Nigel ROBERTS Deganwy, Llandudno.
Exhibits 2, 3 and 4 identify a property in Deganwy, Llandudno and the business premises of ROBERTS that of Nigel Roberts Newsagents located on Gloddaeth Street, Llandudno. The images on exhibits 2 and 3 appear to have been taken directly from TV interviews with the subjects. The image on exhibit 4 looks to be a photograph of a Planning Decision.
My initial enquiries took me to the registered owner of the domain name that of Mr Alexander Robinson of Llandudno. I met with Mr ROBINSON at 1400 on Thursday 9th June 2011. Mr ROBINSON informed me that he had signed over the “usage” of the site to Mr Ian Ralph of “Kindways” computer repairs in Llandudno. Mr Robinson also informed me that it was believed that Mr Nigel ROBERTS was the person contributing to the “Thoughts of Oscar” under the name of Oscar to the blog site and he went on to state that this was the general opinion of those working in an around Llandudno within the local Web sites community.
At 1500 on Thursday 9th June 2011 I met with Mr Ian RALPH of “Kindways” computer repairs shop at his shop location. I asked Mr RALPH if he had anything to do with “The Thoughts of Oscar” blog site. He informed me that he ran a number of websites in the North Wales area and “Thoughts of Oscar” was one of them.
I asked RALPH if he would provide me with the names of those persons involved with the posting of the offensive and in some cases libellous blogs on “Thoughts of Oscar” and he stated that although he knew who the people responsible were he could not name them as his business involved “repairing and cleaning” the computers of local businesses including solicitors and accountants. I promised RALPH that I would do all I could to keep his anonymity. After a short time RALPH looked at me and I asked is Nigel ROBERTS involved in the site, RALPH nodded, I asked is Dylan MOORE involved in the site, RALPH nodded, I asked if David JONES MP involved in the site, again RALPH nodded. I thanked RALPH and departed his premises. In Late January 2015, Mr Richard WINDMILL met with RALPH and covertly recorded a conversation in which my allegations were put to RALPH, RALPH confirmed that he had indicated to me that ROBERTS, MOORE and JONES were connected to the site, he went on to state that MOORE was the go between between ROBERTS and JONES which was the extent of MOORES involvement in the site.
I attended at David Jones Solicitors at 1045 on Monday 13th June 2011. On entry to the premises I asked the receptionist if I could speak to Mr Dylan MOORE, she informed me that he was in a brief meeting but should not be too long and if I wanted to wait she would ask him if he would speak to me. The receptionist asked what it was concerning and I informed her of who I was and that I was investigating alleged malicious postings on a blog site and that Mr MOORE’S name had been passed to me as someone who may be able to help in my enquiries.
I observed Mr MOORE depart an office to the right of the receptionist. He looked directly at me and then went upstairs. A short time later the receptionists phone range and after she put the phone down she stated the following. “Mr MOORE has said that unless you state exactly what your meeting is regarding he will not see you”. I informed her that it was regarding alleged malicious blogs posted on the Thoughts of Oscar blog site. Instead of phoning Mr MOORE back the receptionists went upstairs. When she returned the receptionist stated the following “Mr MOORE does not wish to discuss it with you”. I asked the receptionist what she knew of “thoughts of Oscar” and she stated the following “I am not allowed to discuss it with you, sorry”. I thanked her and left the premises.
At 1133 on Monday 13th June 2011 I attended the property of Mr Nigel ROBERTS. It was my intention to question Mr ROBERTS under caution relating to alleged offences committed under the Communications Act 2003. I observed ROBERTS’S BMW vehicle in the drive.
I knocked on the door and waited for some time. At 1135 I left the property and took up an observation point further up Hawes drive where I could clearly see vehicles departing or arriving at the property.
At 1205 a BMW VRN NIJ 349 arrived at the property and entered through the electronic security gates.
Once again I went to the property and knocked on the door.
In mid-January 2015 In contacted the offices of David JONES MP in relation to a matter unrelated to the investigation into the Thoughts of Oscar. The PA to JONES took my details and informed me he would ask JONES to call me back later that day.
At approximately 1730 on that same day I received a call from JONES who did not wish to discuss the matter in question but wanted to state that he was not involved with Thoughts of Oscar, he stated this over and over again. JONES stated that he had informed the police regarding an issue with myself but would not state what that was. JONES stated that he would see me in court. I informed JONES that we had evidence that he was involved with Thoughts of Oscar and he stated that “I bet you obtained that evidence illegally”, from this significant statement I took it that he was confirming that there was indeed evidence to be had on top of the covertly recorded statement made by Dylan MOORE in the possession of Mr Richard WINDMILL.
